These terms of use govern your use of our website www.cleanmyplace.com (“Website”), our mobile applications (the “App”), and our services (collectively the “CleanMyPlace Platform”). Kindly review them carefully before you begin using the CleanMyPlace Platform, as they apply to your usage of the CleanMyPlace Platform. By utilising the CleanMyPlace Platform, you acknowledge that you accept these terms, including the terms of our Privacy and Cookies Policy, and that you agree to adhere to them. The term ‘CleanMyPlace’, ‘CleanMyPlace Platform’, ‘us’ or ‘we’ refers to the owner of the website whose registered office is Chroma Domestic Cleaning Services Limited, trading as CleanMyPlace, 22 Sitwell Way, Aberavon, Port Talbot, SA12 6BL, Company Number: 05827930. The term ‘you’ refers to the user or viewer of our website. The use of this website is subject to the following terms of use.
Introduction
a. The CleanMyPlace Platform is provided by CleanMyPlace, a company incorporated in the United Kingdom, to you, as a user of the CleanMyPlace Platform.
b. We have established the terms under which we grant you access to the CleanMyPlace Platform and any services we offer, including our provision of a centralised booking point for selected third-party service providers (“Service Providers”). These terms and conditions include:
(i) Your rights to use the CleanMyPlace Platform (these “Terms of Use”)
(ii) How we will use and protect information about you (our “Privacy and Cookies Policy”); and
(iii) Our Booking Terms and Conditions in relation to the third-party services we offer from the CleanMyPlace Platform (our “Booking Terms and Conditions”).
These may be collectively or individually referred to as our “Terms and Policies”.
c. If you enter any prize competitions or other promotions on the CleanMyPlace Platform, additional terms may also apply in addition to these Terms and Policies. In case of a conflict, the additional terms will prevail.
d. We may update our Terms and Policies occasionally, and up-to-date versions will be accessible via the CleanMyPlace Platform. You should regularly check these Terms and Policies to ensure you agree to any changes. Your continued access or use of the CleanMyPlace Platform will be deemed as acceptance of any changes to the Terms and Policies.
Access to the CleanMyPlace Platform
a. Access to the CleanMyPlace Platform is granted on a temporary basis. We reserve the right to modify or withdraw the CleanMyPlace Platform (and any services offered on it) without prior notice. We hold the right to withdraw, alter, or suspend the CleanMyPlace Platform (or any part of it) at any time without notice. We shall not be liable if the CleanMyPlace Platform or any part of it becomes unavailable at any time or for any duration.
b. You are responsible for making all necessary arrangements to access and view the CleanMyPlace Platform and ensuring that your device has up-to-date anti-virus software. You must also ensure that all individuals accessing the CleanMyPlace Platform through your internet connection are aware of these Terms of Use.
c. Materials and information posted on the CleanMyPlace Platform are not intended as advice, including legal advice, and should not be relied upon as such. To the fullest extent permitted by law, we shall not be held responsible or liable if you rely on such information.
d. You must not:
(i) Use the CleanMyPlace Platform to collect usernames and/or email addresses of members by electronic or other means without our express prior written consent;
(ii) Advertise or offer to sell any goods or services for any commercial purpose, or solicit employment or contract work unrelated to the services offered through the CleanMyPlace Platform;
(iii) Solicit, advertise for, or contact Users in any form for employment, contracting, or any other purpose not related to Services facilitated through the CleanMyPlace Platform without our express written permission;
(iv) Introduce viruses, Trojans, worms, logic bombs, time bombs, keystroke loggers, spyware/adware or any other harmful programs or code that negatively affect (or are intended to negatively affect) computer software or hardware;
(v) Reverse engineer, disassemble, decompile, translate, modify, adapt, licence, sublicense, alter, copy, distribute, hack or interfere with the CleanMyPlace Platform, its servers or any connected networks or attempt to do any of the foregoing;
(vi) Gain, or attempt to gain, unauthorised access to the server hosting the CleanMyPlace Platform, or any server, computer, or database connected with the CleanMyPlace Platform; or
(vii) Attack the CleanMyPlace Platform via a denial-of-service attack or a distributed denial-of-service attack.
e. If you violate these Terms of Use, your right to use the CleanMyPlace Platform will terminate immediately.
Your Account
a. Access to certain features of the CleanMyPlace Platform may necessitate a registered account (“Account”). If you are 18 years of age or older, you can register to create an Account, which will require you to submit accurate, current, and complete personal data. This information will be handled and used according to any consent obtained from you and in compliance with our Privacy and Cookies Policy. A unique username and password will control access to your Account. You are responsible for maintaining the confidentiality and security of your Account password and for all activities that occur under that Account.
b. We reserve the right to decline your Account registration or cancel your Account at any time, particularly if we reasonably believe you have violated any provision of our Terms and Policies.
c. If you believe or suspect that someone other than you has access to your Account, you must change your Account password and promptly contact us at www.cleanmyplace.com/contact.
d. Your privacy is important to us. Our Privacy and Cookies Policy, available here, outlines how we will process your personal data and use cookies when provided to us.
e. Text Messages and Phone Calls. By submitting your phone number and using the CleanMyPlace Platform, you agree that, subject to applicable law, we may use your mobile phone number for calls and, if it is a mobile number, for text (SMS) messages to facilitate the requested services. Standard call or message charges from your phone carrier may apply to calls or text (SMS) messages we send you. You can opt-out of receiving text (SMS) messages from us by replying with the word “STOP” to a text message from us. You acknowledge that opting out of text (SMS) messages may affect your ability to use the CleanMyPlace Platform. You consent to CleanMyPlace’s use of a service provider to mask your phone number when you call or exchange text (SMS) messages with a Service Provider or Service Requestor using a phone number provided by CleanMyPlace. During this process, CleanMyPlace and its service provider will receive and store real-time call data, including the date and time of the call or text (SMS) message, the parties’ phone numbers, and the content of the text (SMS) messages. You agree to the masking process described above and to CleanMyPlace’s use and disclosure of this call data for its legitimate business purposes.
User Contributions
a. The CleanMyPlace Platform features areas where users can interact with one another and with CleanMyPlace, such as user profiles, comments, reviews, and messaging. You are personally responsible for any material (“User Content”) posted through your Account. Some areas within the platform may be public, and CleanMyPlace is not responsible for any information or materials posted in these public areas.
b. We reserve the right to refuse publication or remove any User Content that does not comply with these Terms of Use. We will not be responsible for any loss or damages resulting from our decision to exercise our rights under this clause.
c. Views and opinions expressed in User Content are those of the individual submitting the content and not the views and opinions of CleanMyPlace. However, if you encounter any User Content on the platform that you believe breaches the Acceptable Content guidelines, please notify us by emailing legal@cleanmyplace.com using the subject line “Unacceptable Content” and providing details of the content and its location. We will strive to investigate promptly.
d. If you fail to comply with the Acceptable Content guidelines or if any of your User Content raises concerns, we reserve the right to share that User Content with relevant authorities. If a third party claims that your User Content infringes upon their rights, we reserve the right to disclose your identity to that third party (or their legal counsel).
e. By submitting User Content, you grant us a non-exclusive, irrevocable, transferable, sub-licensable, royalty-free permission to use, reproduce, and publish your User Content (including the right to modify, adapt, or change it) in any media or format without restriction and in perpetuity.
Appropriate Content
You represent and warrant that your User Content:
a. does not include or endorse explicit sexual material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;
b. is not threatening, abusive, or intimidating, nor intended to harass others;
c. does not infringe on anyone’s rights, including intellectual property rights, confidentiality, or privacy; particularly, you should not submit content protected by copyright, trademark, patent, trade secret, moral right, or other proprietary rights without the express consent of the owner;
d. complies with all applicable laws;
e. does not contain defamatory, privacy-invading, obscene, offensive, or hate speech material;
f. does not breach any legal obligation you have towards a third party, such as a contractual duty or duty of confidence;
g. accurately reflects your genuinely-held opinions, especially in reviews;
h. does not misrepresent your identity or affiliation, nor falsely imply that content comes from someone else;
i. does not include unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation, commercial or otherwise;
j. does not encourage, promote, or assist in any unlawful act (e.g., criminal acts, copyright infringement, computer misuse, etc.); and
k. does not feature anyone who has not expressly consented to their image or voice being included on the CleanMyPlace Platform, or anyone under 18 without their parent’s or guardian’s consent;
You agree that you are responsible for any loss or damage we may experience as a result of your breach of these warranties.
Intellectual Property
a. You may access, view, and print out the CleanMyPlace Platform (excluding any User Content that is not yours) (“Platform Content”) in accordance with our Terms and Policies for personal, non-commercial use. When printing or quoting from the Platform Content, you must give us appropriate acknowledgment.
b. The above permission does not affect or restrict any author’s moral rights concerning any Platform Content.
c. We expressly reserve all intellectual property rights in and to the CleanMyPlace Platform and the Platform Content, including domain names, sub-domains, the name “CleanMyPlace”, our logo, service marks, trading names, and/or trademarks. Other trademarks, product/company names mentioned on the Platform may be trademarks of their respective owners or licensors, and rights in such marks are reserved to them.
d. You must not:
(i) Remove any copyright or other proprietary notices contained in the Platform Content;
(ii) Use any Platform Content in a manner that may infringe any copyright, intellectual property right, or other proprietary rights of us or any third parties;
(iii) Use, or cause others to use, any automated system or software to extract Platform Content (i.e., “screen scraping”), except when you and any applicable third party have entered into a written agreement with us explicitly permitting that activity; and/or
(iv) Reproduce, modify, display, perform, publish, distribute, disseminate, broadcast, frame (or use any other browser or border environment), communicate to the public, circulate to any third party, or exploit the CleanMyPlace Platform and/or Platform Content for any commercial purpose without our prior written consent through a written licence agreement.
Linking
a. For non-commercial purposes, you may link to any page of the CleanMyPlace Platform, provided that:
(i) the linking is fair, legal, and doesn’t damage or exploit our reputation unfairly;
(ii) the link doesn’t associate the CleanMyPlace Platform with any offensive, illegal, or objectionable material;
(iii) no association, approval, or endorsement on our part is implied where none exists; and/or
(iv) advertisements, copyright, or other proprietary notices on the CleanMyPlace Platform are not obscured or removed by framing or other means.
b. We reserve the right to revoke linking permission at any time without notice. For commercial linking or other requests, please contact us at cleanmyplace.com/contact.
c. The CleanMyPlace Platform may contain links to third-party websites. Visiting these sites is at your own risk, and we are not liable for their content, accuracy, or the quality of goods/services offered. Links do not imply our affiliation or association with such third-party sites.
d. Our communications may include information from third-party websites and links to source websites. We are not responsible for any material on linked third-party sites or their use of personal data. Accessing linked sites is at your own risk, and our Terms and Policies do not apply to your interactions on third-party websites. We recommend reviewing their terms and policies before proceeding.
Accessing the Platform on Mobile Devices and the App
a. The CleanMyPlace Platform may allow you to access our services, download our Apps, upload content to the Platform, and receive messages on your mobile device (collectively “Device Access Features”). Your mobile device carrier may prohibit or restrict certain Device Access Features, and some features may be incompatible with your carrier or mobile device. Additionally, your mobile device carrier may charge you for standard messaging, data, and other fees related to Device Access Features. CleanMyPlace has no responsibility or liability for any fees or charges incurred when using Device Access Features. You should consult your mobile device carrier to learn about any applicable fees or charges and available plans. Contact your carrier with any other questions regarding these matters.
b. You acknowledge that your use of the platform is subject to any terms set forth by the third party providing the device on which the platform operates (e.g., Apple iOS or Android).
c. CleanMyPlace is not liable if your device is incompatible or if you access the wrong version of the platform for your device. CleanMyPlace reserves the right to terminate your use of the platform or any associated features if you are using it with an incompatible or unauthorised device.
d. Apple App Store Provisions
(i) When accessing or downloading an App from the Apple App Store (“Apple-Sourced App”), you may use it only: (i) on Apple-branded products running iOS; and (ii) as permitted by the “Usage Rules” in the Apple App Store Terms of Service. All rights not expressly granted to you under these Terms of Use are reserved by CleanMyPlace.
(ii) You acknowledge that these Terms of Use are valid between you and CleanMyPlace only, with Apple as a third-party beneficiary. CleanMyPlace, not Apple, is solely responsible for the Apple-Sourced App and its content.
(iii) Apple has no obligation to provide maintenance or support services for the Apple-Sourced App.
(iv) To the maximum extent permitted by law, Apple has no warranty obligation regarding the Apple-Sourced App.
(v) CleanMyPlace, not Apple, is responsible for addressing any claims you may have relating to the Apple-Sourced App, including product liability claims, legal or regulatory non-conformance, and consumer protection claims.
(vi) You agree not to hold Apple responsible for any intellectual property infringement claims arising from your possession or use of the Apple-Sourced App.
(vii) Apple and its subsidiaries are third-party beneficiaries of these Terms of Use for Apple-Sourced Apps and have the right to enforce them against you.
(viii) You must comply with all applicable third-party terms when using the Apple-Sourced App.
Our Liability
a. Nothing in our Terms and Policies shall affect your statutory rights or exclude or limit our liability for death or personal injury arising through our negligence, fraudulent misrepresentation, and/or anything else that cannot be excluded or limited by us under the laws of England and Wales.
b. Limitations of Liability
c. We will not be liable under these Terms for:
(i) Loss or damage caused by us where no legal duty of care is breached, or such loss or damage is not a reasonably foreseeable consequence of the breach;
(ii) Indirect losses occurring as a side effect of the main loss or damage, unforeseeable by both parties (e.g., loss of profits or opportunities); and/or
(iii) Increased loss or damage resulting from your breach of these Terms.
d. To the greatest extent allowed by law, we disclaim all warranties, terms, conditions, and representations that might be implied in relation to this platform. Specifically, we do not guarantee that:
(i) The platform’s content is accurate or complete;
(ii) The platform will be error-free, free from harmful components, or that defects will be corrected. You are responsible for taking necessary precautions. We are not liable for any loss or damage caused by attacks, viruses, or other harmful elements infecting your computer or data due to platform use.
e. The platform is provided “as is,” and we do not take responsibility for any inaccuracies, typographical errors, or failure to maintain the platform.
10. Governing Law and Disputes
a. These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales.
b. In case of any dispute or claim arising out of or in connection with these Terms of Use or your use of the CleanMyPlace Platform, we will make reasonable efforts to resolve such dispute or claim amicably through good faith negotiations. If we are unable to resolve the dispute or claim within a reasonable time period, either party may refer the dispute or claim to the courts of England and Wales.
